The popular textbook Equity and Trusts by Alastair Hudson has a sibling volume called Understanding Equity and Trusts that provides a clear, accessible, readable, and thorough explanation of the key ideas in this dynamic field of law for individuals who are unfamiliar with it. This book gives the reader a useful foundation in all of the fundamental ideas of equity and the law of trusts, whether it is used at the start of studying this subject, as a study aid, or throughout the time leading up to exams.

This book covers every subject that a reader in a trusts law or general equity course will come upon. The work covers explicit, resultant, and constructive trusts, trustee responsibilities, trust breaches and tracking, commercial trust uses, charities, pension plans, real estate trusts, and equitable remedies.

The third edition has been updated and amended to provide fresh information on trustee responsibilities and investment trusts. The chapter on charities has also undergone a significant rewrite in light of the Charities Act 2006.

Trust law is based on several fundamentally straightforward ideas. This book takes the method of clearly outlining those ideas at the outset before helping the reader through the more challenging problems that are common in exams on this topic. The engaging book uses a lot of simple examples to make the general law debate more approachable.

 

Author

Twenty of them were authored by Alastair between 1996 and 2012, with many appearing in numerous editions. They cover a remarkably wide spectrum of legal topics. He is a National Teaching Fellow, a Professor of Equity & Finance Law at the University of Southampton, and the 2017 UK Law Teacher of the Year. He is also an Academic Member of the Chancery Bar Association, a Fellow of the Higher Education Academy, and a Fellow of the Royal Society of Arts.

In addition to being a scholar whose work has been cited by scholars worldwide and served as the foundation for court rulings, he is most concerned with engaging his audience and effectively communicating with them. Books for practitioners are therefore intellectual, useful, and clear, whereas books for students are accessible, readable, helpful, and occasionally even entertaining. His works all exhibit a passion that is uncommon in legal writing.

Alastair has published in a variety of new areas, particularly in the areas of securities law, financial derivatives law, and law of finance, where he has distinguished himself as one of the top academic authorities worldwide. Even when writing in more conventional disciplines, he takes a fresh and engaging approach, always keeping his readers’ needs in mind. For instance, The Law of Finance is the first book of its type in the field and combines in-depth research on private law with an examination of the whole spectrum of financial markets and products as well as the areas of financial regulation.

On his website (www.alastairhudson.com), he has also developed a variety of podcast and vidcast teaching techniques to aid both students and professionals, along with a wealth of articles that complement his books that have been released. On that website, he has written a number of fiction pieces that complement his scholarly work. Innovating the free online distribution of his lectures, thoughts, and research demonstrates his dedication to being a teacher first and foremost, and more significantly, a teacher for anybody who wants to learn.

Alastair lectured from 1993 at King’s College before moving on to Queen Mary & Westfield College where he served as Professor of Equity & Law for a while. He has served as Professor of Equity and Finance Law at the University of Southampton since September 2012. Before concentrating solely on academic study, he worked in investment banking, practiced law, and participated in British politics. He served as a constitutional and legal affairs policy advisor to the British Labour Party from 1992 to 1997, and he still offers guidance on financial law and financial regulation policy today. He has ideas when taking walks on the South Downs and writes novels in his own time.

The legal and regulatory settings of the global financial crisis, the law on trusts of houses, the notion of conscience in law, and the big debates in equity and trusts law are just a few of the studies that will be covered in upcoming projects.

The Financial Law
This 2009 publication provides a comprehensive overview of finance law in a single, 1,400 page volume that may be used to instruct both undergraduate and graduate students. The totality of the financial markets is covered in the book (uniquely), including banking and lending, securities, derivatives and collateralization, stock lending and repo’s, foreign currency, collective investment and communal investment companies, mortgages, and insurance regulation.

There are two portions to the book. The second half examines how those principles apply to particular financial markets, as well as the standard market documentation used in those markets and their unique regulatory codes. The first half examines the regulatory fundamentals and the core principles of the substantive law that apply to finance. The book is the result of the author’s academic and financial industry experience spanning twenty years. The book includes a glossary of technical words, and each chapter opens with a synopsis of what it will cover. Both incisive legal analysis and simple-to-understand examples are used to demonstrate the ideas.

Videos and podcasts that support the book are available. Aristotle (on the nature of money), John Maynard Keynes, and Charles Dickens are only a few of the intellectuals included in the references, in addition to discussions of over 1,000 cases and countless legislative and regulatory provisions. Written by someone who has worked in the area and written about it for more than two millennia, it is an engaging and vibrant overview of this quickly evolving topic!

In 2010, a different, more recent practitioner edition of this book was released.

Equities and Trusts
The seventh edition of this incredibly well-liked textbook will be released in 2012. Each chapter begins with a concise explanation of the important ideas, and the book is made more approachable with working examples (showing how the law affects real people and real situations). At the conclusion of each section of the book, there are articles that reflect on the major problems covered and provide views on essay writing. With frequent new editions and online updates to reflect new cases and legislative changes in England and Wales and abroad, this book is thorough and still the most current, complete book on the market. This textbook is extremely intellectual, yet it was created for students to learn equity and trusts law, not just to impress other academics. This book is increasingly utilized by practitioners and has been mentioned in court in numerous different jurisdictions.

The Financial Derivatives Law
The world’s most significant, academic discussion of the law pertaining to financial derivatives is still this book. The implications of the global financial crisis on the regulation of derivatives in the UK, the EU, and the USA are examined in a new, fifth edition that was published in 2012. In past publications, Alastair had long anticipated the part that derivatives would play in a financial collapse. Derivatives’ new regulatory environment is carefully taken into account.
The study of the numerous new cases from the Supreme Court, Court of Appeals, and High Court following the failure of Lehman Brothers and Kaupthing is one of the other key shifts. A special review of derivatives paperwork, the new tax legislation, and the plethora of UK cases that have resulted from them is also included.
This book is often referred to by practitioners and has been used as evidence in courts across the world. The fifth edition, published in 2012, examines 200 new cases, new EU legislation, and a number of statutory changes to UK law. Alastair spent a number of years working in the derivatives markets for Citibank and Goldman Sachs, respectively.

Comprehending business law
This recent book on corporation law, which was released in 2011, approaches the topic in an intriguing and occasionally unconventional manner. (That much is clear from the cover, which echoes boots similar to those manufactured by Aron Salomon in the seminal case in this area, but every other book has a drab image of an office building. In subsequent parts of this book, the production of boots and shoes is discussed in relation to the hiking and skiing apparel industries of contemporary firms like Nike and Salomon in the twenty-first century.) The book is suitable for students at the numerous law schools that take a more progressive approach to this subject because of its detailed study of important company law cases that brings the topic to life and its discussions of corporate governance and corporate social responsibility.
